How GameXcel, studios, and playtesters work together. Last updated: June 2026.
This document is a template. It is provided as a starting point and is not legal advice. The GameXcel team should review and adapt it with qualified counsel before relying on it in production.
By using GameXcel, you agree to these terms.
These Terms of Service form a binding agreement between you and GameXcel. By creating an account, accessing a studio workspace, or otherwise using the GameXcel service, you accept these terms. If you do not agree, do not use the service.
Who can use the service.
You must be at least 16 years old and able to enter into a binding contract in your jurisdiction. If you are using GameXcel on behalf of a studio or other entity, you represent that you have authority to bind that entity to these terms.
Your responsibility for the account.
Keep your password or third-party sign-in credentials confidential. You are responsible for activity that occurs under your account.
Provide accurate profile and studio information and keep it up to date. Misrepresentation may lead to suspension.
What you cannot do.
Do not harass, threaten, or harm other users. Do not post hateful or illegal content.
Do not submit fake feedback, manipulate ratings, farm rewards, or impersonate other people or studios.
Do not redistribute studio builds, assets, screenshots, or non-public information outside the project, even if not under a formal NDA.
Do not probe, scrape, or reverse engineer the service, except to the limited extent permitted by applicable law.
Do not exceed plan quotas or rate limits, or interfere with the operation of the service.
Use the service only in compliance with applicable laws, including export controls and sanctions.
Specific terms for studios.
A studio account may invite team members and operate projects. The studio is responsible for content it uploads (briefs, builds, marketing materials) and for granting access only to authorized team members.
Studios decide who can see a project. Projects marked as private are visible only to invited playtesters; public listings are surfaced to the broader playtester community. Studios that share confidential materials are responsible for their own NDA flow and confidentiality measures.
Paid plans are billed in advance for the period selected. Plan limits (seats, projects, AI insights) are described on the pricing page and may change with reasonable notice.
Specific terms for playtesters.
Applying to a playtest does not guarantee selection. When you are invited and accept, you agree to provide honest, good-faith feedback within the timeframe communicated by the studio.
By submitting feedback through GameXcel, you grant the studio operating the project a non-exclusive, royalty-free, worldwide license to use that feedback to improve their game. You also grant GameXcel a limited license to host, display, and process the feedback inside the platform.
Reward points and XP have no cash value and may be adjusted, expired, or revoked in cases of fraud or terms violations. Redemption mechanics, where offered, are described in-app.
Who owns what.
The GameXcel name, logo, software, design system and documentation are owned by GameXcel. These terms grant you no rights in our IP beyond the right to use the service.
You retain ownership of the content you submit. You grant GameXcel a limited license to host and display that content as needed to operate the service.
The service is provided "as is".
To the maximum extent permitted by law, GameXcel disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or perfectly secure.
Caps on damages.
To the maximum extent permitted by law, GameXcel will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total aggregate liability for any claim arising out of or relating to the service will not exceed the amounts you paid GameXcel in the twelve months preceding the event giving rise to the claim, or one hundred euros, whichever is greater.
When access ends.
You may close your account at any time from the in-app settings or by contacting us. We may suspend or terminate access if you breach these terms, if your use creates risk for GameXcel or other users, or as required by law. On termination, sections that are intended to survive (IP, disclaimers, liability, governing law) remain in effect.
Where disputes are resolved.
These terms are governed by the laws of the jurisdiction in which the GameXcel operating entity is established, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the courts of that jurisdiction, unless mandatory consumer-protection rules grant you the right to bring proceedings in another forum.
When these terms update.
We may update these terms as the product evolves. Material changes will be announced on this page with a new "last updated" date and, where appropriate, in-app or via email. Continued use after changes take effect constitutes acceptance.
